Federal Judge Blocks Virginia’s ICE Mask Ban

The judge stated that the Justice Department is likely to win the lawsuit against the anti-mask legislation.

U.S. District Judge Robert Payne issued a preliminary injunction blocking a Virginia law that would prohibit Immigration and Customs Enforcement (ICE) officers from wearing masks. The Department of Justice (DOJ) sued Virginia Attorney General Jay Jones and the Fairfax County Commonwealth’s Attorney Steven Descano for what they are calling an “unconstitutional” mask ban. 

In his order, Judge Payne found that the Justice Department is “likely to suffer irreparable injury” due to the state law. He also found that the federal government is likely to succeed in its claim that the U.S. Constitution prohibits states from regulating federal law enforcement. The injunction issued by Judge Payne will remain in force until the legal process regarding the no-mask ban is resolved. 

There are also ongoing lawsuits for similar bans in New Jersey and New York.
